General Terms and Conditions (GTC) for the online shop
- Scope
1.1 These General Terms and Conditions (hereinafter "GTC") apply to all orders and contracts concluded via the online shop (hereinafter "Shop") between the customer and PromoGift (hereinafter "we" or "us").
1.2 Deviating conditions of the customer will not be accepted unless we have expressly agreed to their validity in writing.
- Conclusion of contract
2.1 The presentation of the goods in the shop does not constitute a legally binding offer, but a non-binding invitation to order.
2.2 By submitting the order in the shop, the customer makes a binding offer to purchase the selected goods.
2.3 We will confirm receipt of the customer's order immediately by email. This order confirmation does not constitute acceptance of the offer, but merely informs the customer that we have received his order.
2.4 A contract is only concluded when we declare acceptance of the offer by means of a separate order confirmation by email or when we send the goods to the customer.
- Prices and payment terms
3.1 The prices stated in our shop are in Swiss francs (CHF) and include VAT.
3.2 Payment of the purchase price can be made by credit card, TWINT, PayPal, purchase on account or advance payment.
3.3 If you choose to pay in advance, we will give you our bank details in the order confirmation. The invoice amount must be transferred to our account within 10 days of receiving the order confirmation.
- Delivery and shipping costs
4.1 The ordered goods will be delivered to the delivery address specified by the customer.
4.2 The delivery time is shown to the customer in the product description or when ordering.
4.3 Shipping costs are to be borne by the customer and will be clearly communicated to him before completing the order.
- Right of withdrawal
5.1 The customer has a statutory right of cancellation. Information on the right of cancellation and the cancellation form will be made available to the customer separately.
5.2 The customer shall bear the return costs when exercising the right of withdrawal.
- Warranty and liability
6.1 The statutory warranty rights apply.
6.2 We shall be liable to the customer without limitation for damages resulting from injury to life, body or health as well as for damages resulting from grossly negligent or intentional breach of duty on our part.
6.3 We shall only be liable for other damages in the event of a breach of a material contractual obligation, but the amount shall be limited to the damages typically foreseeable at the time the contract was concluded.

- Final provisions
8.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
8.2 Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
8.3 The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions is our registered office.
